BP suspended from new U.S. government contracts

WASHINGTON (Reuters) - The British oil company BP Plc and its affiliates have been suspended from new contracts with the U.S. government due to the criminal charges in the Deepwater Horizon oil spill in 2010, the U.S. Environmental Protection Agency said on Wednesday.

Earlier this month, BP plead guilty to criminal misconduct in the Gulf of Mexico disaster, the worst oil spill in U.S. history, and agreed to pay record penalties of $4.5 billion.

The temporary contract suspension stems from those charges, the EPA said.

"Federal executive branch agencies take these actions to ensure the integrity of federal programs by conducting business only with responsible individuals or companies. Suspensions are a standard practice when a responsibility question is raised by action in a criminal case," the EPA said in a statement.

In London, BP had no immediate comment. The company recognized the risk that it could be banned from U.S. government contracts when it agreed earlier this month to plead guilty to criminal charges over the spill, but it said at the time that it had not received any indication that government departments would go ahead with such a ban.

(AP) ? Notre Dame's experience and raucous home crowd were too much for eighth-ranked Kentucky and its heralded freshmen.

Junior guards Eric Atkins and Jerian Grant paced the Fighting Irish to a 64-50 victory Thursday night.

Atkins led the Fighting Irish with 16 points, Grant had 13 points and six assists and Jack Cooley added 13 points and 11 rebounds.

"The way our guards were controlling things, I didn't have to do a lot of coaching," Notre Dame coach Mike Brey said.

"Those guys were coaching the team. Eric Atkins running things, calling sets. When you have a veteran backcourt doing that, I just don't want to get in their way too much."

Notre Dame outplayed Kentucky (4-2) inside during the first half and held the Wildcats to a season-low 40 percent shooting for the game.

The Irish shot 48 percent, the best anyone against Kentucky this season.

The senior captains of the top-ranked Notre Dame football team, linebacker Manti Te'o, defensive end Kapron Lewis-Moore, tight end Tyler Eifert and tackle Zack Martin, got a standing ovation when they were introduced at halftime.

Students rushed the floor after the Irish wrapped up their second win over the Wildcats in the past 13 meetings.

Grant was disappointed in the fans' reaction, saying it wasn't like last season when the Irish upset top-ranked Syracuse.

"I'd rather not have them on the court. Last year was kind of a surprise game. This year, going into it, all of us were expecting to win this game," he said.

Kentucky coach John Calipari said his team didn't compete.

"They beat us to balls. They beat us around the basket. We didn't compete. We didn't execute. We didn't play together. There's a lot of things we didn't do," he said.

Julius Mays led Kentucky with 16 points and Nerlens Noel had 10.

"We came out a little shell-shocked and we started playing their game, which is slow down and half court. I think we're more of an up-tempo team," Mays said.

Two of Kentucky's heralded freshmen struggled. Archie Goodwin, who is averaging 19 points, was 1 of 7 shooting and finished with three points and Alex Polythress, who is averaging 18.4 points, had just one basket and was 1 of 3 from the free-throw line.

The Irish outrebounded Kentucky 33-27.

"We just knew that we could attack their bigs," Cooley said. "We watched film on them and knew that they had young bigs, and we could try to outsmart them instead of out-athleticizing them. Not really change how we play but just do what we do."

Brey said his team played with poise whenever Kentucky started rallying.

"When we don't have good offensive stretches, we're still able to concentrate defensively," he said.

Notre Dame led 36-25 at halftime. The lead was around 10 points when Cameron Biedscheid, who had 10 points, hit a 3-pointer to ignite a 10-0 run that included a 3-pointer by Grant and another jumper by Biedscheid and gave Notre Dame a 55-35 lead.

Notre Dame wore black uniforms with stitched green letters and numbers that were hard to see and the crowd wore black in support of the team.

Atkins said the victory should help the Irish during the season.

"It just boosts our confidence that we can do it against an elite team," he said.

Calipari said he hopes his team learned something in the loss.

"What I hope they figure out is you've got to do it together. You have to give Notre Dame credit. What a great crowd, with a great student body. They ground us out. That's how we usually play when we get up," he said.

Factory owner: I didn't know fire exits needed

DHAKA, Bangladesh (AP) ? The owner of a Bangladesh clothing factory where a fire killed 112 people says he was never informed the facility was required to have an emergency exit, a sign of how far removed the leaders of the nation's garment industry are from issues of worker safety.

"It was my fault. But nobody told me that there was no emergency exit, which could be made accessible from outside," factory owner Delwar Hossain was quoted Thursday as telling The Daily Star newspaper. "Nobody even advised me to install one like that, apart from the existing ones."

"I could have done it. But nobody ever suggested that I do it," said Hossain, who could not be reached for comment by The Associated Press on Thursday.

Activists in the South Asian country hope the tragedy will invigorate their lengthy ? but fruitless ? efforts to upgrade safety standards and force stronger government oversight of the powerful industry.

The Tazreen Fashions Ltd. factory in a Dhaka suburb was making clothes for Wal-Mart, Sears, Disney and other major global retailers. When a fire broke out over the weekend, many of the 1,400 workers were trapped inside the eight-story building because exit doors were locked. A fire official said the death toll would have been much lower if the factory had had an emergency exit.

Police said they were interrogating three factory managers on possible negligence charges. Workers said as they tried to escape the fire they found exit doors were locked.

An AP reporter who visited the damaged factory Wednesday found three stairways but no special fire exits.

Hossain, a former accounts manager at another garment factory, set up his own clothing business, Tuba Textiles Mills Ltd. in 2004. The Tazreen factory was one of a dozen owned by his company.

Labor Minister Rajiuddin Ahmed Raju said that factories without emergency exits ? or with only one such exit ? will be forced to close until they upgrade their safety infrastructure. It was not clear when and how that directive will be enforced.

Nazma Akhter, president of the Bangladesh Combined Garment Workers Federation trade union, called for the arrest of the factory's owners and management to send a message to the industry as a whole.

"There should be a criminal case against them. It could stop the recurrence of such incidents," he said.

In 2001, Bangladesh's High Court directed the government to set up a committee to oversee the safety of garment workers after a similar fire in a factory killed 24 people. But that directive was never implemented, and more than 300 people have been killed in garment factory fires since 2006.

"It's unfortunate that the government has ignored the directive. Had the government complied with it there would have been fewer accidents, I believe," said Sultana Kamal, executive director of Ain O Salish Kendra, a legal and human rights group that had petitioned the court for the ruling.

Government officials did not respond to calls for comment.

An Associated Press reporter at the factory discovered children's shorts with Wal-Mart's Faded Glory label, hooded sweat shirts emblazoned with Disney cartoons, shorts with hip-hop star Sean Combs' ENYCE tag, and sweaters from the French company Teddy Smith and the Scottish company Edinburgh Woollen Mill. Sears was among the companies listed in the account books.

Wal-Mart said it received a safety audit that showed the factory was "high-risk" and had decided well before the blaze to stop doing business with Tazreen. But it said a supplier had continued to use Tazreen without authorization. The retailer said it stopped doing business with the supplier Monday.

Sears said it learned after the blaze that its merchandise was being produced there without its approval through a vendor that has since been fired. Walt Disney Co., which licenses its characters to clothing makers, said its records indicate that none of its licensees have been permitted to make Disney-brand products at the factory for at least a year.

The Bangladesh Garment Manufacturers and Exporters Association fears the repercussions if Western companies pull out of the country's $20 billion a year garment business. Wal-Mart alone buys about $1 billion of garments here.

"It's the time of solidarity, not to go away. Wal-Mart should come forward to resolve existing issues through discussion and an attitude of partnership," said Shafiul Islam Mohiuddin, president of the trade group. "Otherwise, what will happen? Manufacturers would lose orders, workers will lose their jobs. This could create another complicated situation. For whose interest? None will benefit from it."

The molecular mechanisms whereby a spectrum of dahlias, from white to yellow to red to purple, get their colour are already well known, but the black dahlia has hitherto remained a mystery. Now, a study published in BioMed Central's open-access journal BMC Plant Biology reveals for the first time that the distinctive black-red colouring is based on an increased accumulation of anthocyanins as a result of drastically reduced concentrations of flavones.

Dahlia variabilis hort. is a popular garden flower. Continuous dahlia breeding worldwide has led to the availability of a huge number of cultivars ? 20,000 varieties ? many of them showing red hues. However, black hues of dahlia flowers occur rarely, in comparison.

Flower colour in dahlias is exclusively based on the accumulation of a group of metabolites called flavonoids, for example anthocyanins, flavones and flavonols. It's known that red tones arise from anthocyanins, whilst white and yellow tones lack anthocyanins but contain large amounts of flavones and chalcones respectively. Flavones and flavonoids are colourless, but they influence flower colouration by acting as co-pigments, interacting with anthocyanins to stabilize their structures. It is assumed that flavones rather than flavonols are the predominant co-pigments present in dahlias since all cultivars show high flavone synthase II (FNS) enzyme activity and low flavonol synthase activity.

To examine the biochemical basis for the distinctive dark colouring of the black dahlia, the research team from the Vienna University of Technology in Austria used pigment, enzyme and gene expression analyses. They determined that the majority of black cultivars have very low concentrations of flavones, as confirmed by low FNS II expression. Since flavones compete with anthocyanin biosynthesis for common intermediates, the lack of flavones favours the accumulation of huge amounts of anthocyanins that are found in black dahlias. The flavonol contents of black dahlias increased slightly parallel to the decrease of flavones.

Heidi Halbwirth, lead author, emphasised that the black colour of dahlias is not due to increased activity of the anthocyanin pathway, but rather is the result of the intermediates being converted into anthocyanins at the expense of formation of flavones.

Halbwirth commented, "The molecular explanation for the specific suppression of flavone formation in the majority of black dahlias will be of interest for further research. As the dahliais an octoploid plant and the presence of several alleles is expected, the simultaneous suppression of all FNS II isoenzymes indicates an effective mechanism that could be used for engineering plants with tailor-made flavone contents."

Installed price of solar photovoltaic systems in US continues to decline at rapid pace

ScienceDaily (Nov. 27, 2012) ? The installed price of solar photovoltaic (PV) power systems in the United States fell substantially in 2011 and through the first half of 2012, according to the latest edition of Tracking the Sun, an annual PV cost-tracking report produced by the Department of Energy's Lawrence Berkeley National Laboratory (Berkeley Lab).

The median installed price of residential and commercial PV systems completed in 2011 fell by roughly 11 to 14 percent from the year before, depending on system size, and, in California, prices fell by an additional 3 to 7 percent within the first six months of 2012. These recent installed price reductions are attributable, in large part, to dramatic reductions in PV module prices, which have been falling precipitously since 2008.

The report indicates that non-module costs -- such as installation labor, marketing, overhead, inverters, and the balance of systems -- have also fallen significantly over time. "The drop in non-module costs is especially important," notes report co-author Ryan Wiser of Berkeley Lab's Environmental Energy Technologies Division, "as these costs can be most readily influenced by local, state, and national policies aimed at accelerating deployment and removing market barriers." According to the report, average non-module costs for residential and commercial systems declined by roughly 30 percent from 1998 to 2011, but have not declined as rapidly as module prices in recent years. As a result, non-module costs now represent a sizable fraction of the installed price of PV systems, and continued deep reduction in the price of PV will require concerted emphasis on lowering the portion of non-module costs associated with so-called "business process" or "soft" costs.

The report indicates that the median installed price of PV systems installed in 2011 was $6.10 per watt (W) for residential and small commercial systems smaller than 10 kilowatts (kW) in size and was $4.90/W for larger commercial systems of 100 kW or more in size. Utility-sector PV systems larger than 2,000 kW in size averaged $3.40/W in 2011. Report co-author Galen Barbose, also of Berkeley Lab, stresses the importance of keeping these numbers in context, noting that "these data provide a reliable benchmark for systems installed in the recent past, but prices have continued to decline over time, and PV systems being sold today are being offered at lower prices."

Based on these data and on installed price data from other major international PV markets, the authors suggest that PV prices in the United States may be driven lower through large-scale deployment programs, but that other factors are also important in achieving installed price reductions.

The market for solar PV systems in the United States has grown rapidly over the past decade, as national, state and local governments offered various incentives to expand the solar market and accelerate cost reductions. This fifth edition in Berkeley Lab's Tracking the Sun reportseries describes historical trends in the installed price of PV in the United States, and examines more than 150,000 residential, commercial, and utility-sector PV systems installed between 1998 and 2011 across 27 states, representing roughly 76 percent of all grid-connected PV capacity installed in the United States. Na?m Darghouth, also with Berkeley Lab, explains that "the study is intended to provide policy makers and industry observers with a reliable and detailed set of historical benchmarks for tracking and understanding past trends in the installed price of PV."

Prices Differ by Region and by Size and Type of System

The study also highlights the significant variability in PV system pricing, some of which is associated with differences in installed prices by region and by system size and installation type. Comparing across U.S. states, for example, the median installed price of PV systems less than 10 kW in size that were completed in 2011 and ranged from $4.90/W to $7.60/W, depending on the state.

It also shows that PV installed prices exhibit significant economies of scale. Among systems installed in 2011, the median price for systems smaller than 2 kW was $7.70/W, while the median price for large commercial systems greater than 1,000 kW in size was $4.50/W. Utility-scale systems installed in 2011 registered even lower prices, with most systems larger than 10,000 kW ranging from $2.80/W to $3.50/W.

The report also finds that the installed price of residential PV systems on new homes has generally been significantly lower than the price of similarly sized systems installed as retrofits to existing homes, that building integrated PV systems have generally been higher priced than rack-mounted systems, and that systems installed on tax-exempt customer sites have generally been priced higher than those installed at residential and for-profit commercial customer sites.

Price Declines for PV System Owners in 2011 Were Offset by Falling Incentives

State agencies and utilities in many regions offer rebates or other forms of cash incentives for residential and commercial PV systems. According to the report, the median pre-tax value of such cash incentives ranged from $0.90/W to $1.20/W for systems installed in 2011, depending on system size. These incentives have declined significantly over time, falling by roughly 80 percent over the past decade, and by 21 percent to 43 percent from just 2010 to 2011. Rather than a direct cash incentive, some states with renewables portfolio standards provide financial incentives for solar PV by creating a market for solar renewable energy certificates (SRECs), and SREC prices have also fallen dramatically in recent years. These declines in cash incentives and SREC prices have, to a significant degree, offset recent installed price reductions, dampening any overall improvement in the customer economics of solar PV.

Photographers based in the UK now have an easier and cheaper legal path to take if they discover someone infringing upon their copyrights. Chris Cheesman of Amateur Photographer writes that photographers can now receive do-it-yourself justice without having to hire a lawyer:

Intellectual property disputes can now be resolved using the ?small claims track? in the Patents County Court (PCC), following a Government announcement of a ?simpler and easier? system last month. Photographers can pursue damages for breach of copyright, for up to ?5,000, without even appointing a solicitor, unlike before where they may have been put off by a potentially long, and expensive, legal fight.

Furthermore, the damages limit may rise to ?10,000 under Ministry of Justice proposals, possibly as early as next year. Crucially, under the new system, photographers can avoid the prospect of a lengthy court battle and the fear of having to pay the legal fees of the successful party if they lose.

Apparently the US Government is currently looking into doing something similar.

4. Consider franchising your business if you are interested in expanding without spending most of the money yourself.? Realistically speaking, few small businesses can be franchised, but it is possible if you offer superior products or services that are in high demand and your business model is easy to duplicate. Setting up the legal end of things will involve significant costs, but you could expand your business and earn franchise fees.

These are just a few suggestions to help your small business grow and avoid significant debt. If you honestly feel that bankruptcy may be your best option, it would be wise to meet with a legal professional for feedback and advice.

Netanyahu: Israel ready for 'expansion' in Gaza

Updated at 6:45 a.m. ET: TEL AVIV, Israel?- Israel was prepared to substantially broaden its operation in the Gaza strip, the country's prime minister said on Sunday.?

"The Israel Defense Forces have attacked more than 1,000 terror targets in the Gaza Strip," Prime Minister Benjamin Netanyahu said at a cabinet meeting. "We are exacting a heavy price from Hamas and the terrorist organizations and the Israel Defence Forces are prepared for a significant expansion of the operation."?

He gave no specifics and made no mention of the possibility of a ground offensive.?

Also on Sunday, at least one rocket fired from Gaza was shot down by Israel's Iron Dome air shield, witnesses and officials said. ?Israeli officials told NBC News that there was one rocket fired at the country's commercial capital, Tel Aviv. Previous reports had put the number of rockets at two.

According to NBC staff in Tel Aviv, sirens sounded at about 10:30 a.m. (3:30 a.m. ET). NBC's Paul Goldman saw at least one rocket?being intercepted by Israel's anti-rocket defense system over the center of Tel Aviv.

'Some indications' Hamas-Israeli truce is possible, Egypt says

"I was taking cover and heard a huge bang," Goldman said. "(I) looked up and saw the explosion in the air above me. I could smell the fire."

Gaza's Hamas militants said they launched two Iranian-designed Fajr-5 rockets at Tel Aviv, which has come under several such salvos since cross-border fighting with the Palestinian enclave erupted on Wednesday.?

NBC's Ayman Mohyeldin reports from Gaza City, where the streets remain empty as Palestinians brace for overnight air strikes as part of Israel's intense aerial campaign.

Israel, meanwhile, continued bombing Palestinian militant targets in Gaza from air and sea, preparing for a possible ground invasion though Egypt saw "some indications'' of a truce ahead."

"If there is quiet in the South and no rockets and missiles are fired at Israel's citizens nor terrorist attacks engineered from the Gaza Strip, we will not attack,"?Israeli Vice Prime Minister Moshe?Yaalon said over Twitter.?

How Israel's 'Iron Dome' intercepts incoming rockets in Gaza conflict

Israel's strikes were indeed causing widespread damage, NBC News'?Ayman?Mohyeldin said from Gaza.

"These strikes are portrayed as precision strikes, but they are anything but that given how densely populated the area is," he said.?

Forty-eight Palestinians, about half of them civilians, including 13 children, have been killed in Israel's raids, Palestinian officials said. More than 500 rockets fired from Gaza have hit Israel, killing three people and injuring dozens.

Overnight, six journalists were wounded in Gaza City when Israeli warplanes hit a television station,?according?to Agence France-Presse.?Reuters said witnesses identified the station as al Quds, which Israel sees as pro-Hamas.?Sky News reported that around 5 a.m. local time, two missiles?hit the building that houses its studios and offices.?Al-Arabiya also said?that its offices had been hit.

An Israeli military spokeswoman said the strike had targeted a rooftop "transmission antenna used by Hamas to carry out terror activity."?

Israel unleashed intensive air strikes on Wednesday, killing the commander of the Hamas Islamist group that governs Gaza and spurns peace with Israel. Israel's declared goal is to deplete Gaza arsenals and press Hamas into stopping cross-border rocket fire that has plagued Israeli border towns for years.

Air raids continued past midnight into Sunday, with warships shelling from the sea.?

'Some indications' Hamas-Israeli truce is possible, Egypt says

Two other predawn attacks on houses in the Jabalya refugee camp killed two children and wounded 13 other people, medical officials said.

NBC's Martin Fletcher and Richard Engle report from Tel Aviv and Gaza, where violence is ramping up with Palestinians firing rockets into Israel and Israel's military attacking Hamas symbols of power such as the prime minister's office and police headquarters.

These attacks followed a defiant statement by Hamas military spokesman Abu Ubaida, who told a news conference: "This round of confrontation will not be the last against the Zionist enemy and it is only the beginning.''

The masked gunman dressed in military fatigues insisted that despite Israel's blows Hamas "is still strong enough to destroy the enemy."

Truce?
Egyptian President Mohamed Morsi said in Cairo as his security deputies sought to broker a truce with Hamas leaders, that "there are some indications that there is a possibility of a ceasefire soon, but we do not yet have firm guarantees.''

Egypt has mediated previous ceasefire deals between Israel and Hamas, the latest of which?unraveled?with recent violence.

Key players in the Israel-Gaza cross-border conflict

A Palestinian official told Reuters the truce discussions would continue in Cairo on Sunday, saying "there is hope,'' but it was too early to say whether the efforts would succeed.

In Jerusalem, an Israeli official declined to comment on the negotiations. Military commanders said Israel was prepared to fight on to achieve a goal of halting rocket fire from Gaza, which has plagued Israeli towns since late 2000, when failed peace talks led to the outbreak of a Palestinian uprising.

NBC's Mike Viqueira and Martin Fletcher report on the latest developments in the ongoing crisis in the Middle East and each weigh in on what role the US would play in a possible ground offensive by Israel into Gaza.

Diplomats at the United Nations said Secretary-General Ban Ki-moon is expected to visit Israel and Egypt in the coming week to push for an end to the fighting.

Ground offensive
Israel, with tanks and artillery positioned along the frontier, said it was still weighing a ground offensive.?

Israeli cabinet ministers decided on Friday to more than double the current reserve troop quota set for the Gaza offensive to 75,000 and around 16,000 reservists have already been called up.

Asked by reporters whether a ground operation was possible, Major-General Tal Russo, commander of the Israeli forces on the Gaza frontier, said: "Definitely.''

Rockets from Gaza fired on Tel Aviv and Jerusalem

?We have a plan. ... It will take time. We need to have patience. It won't be a day or two,'' he added.

A possible move into the densely populated Gaza Strip and the risk of major casualties it brings would be a significant gamble for Netanyahu, favoured to win a January election.

The last Gaza war, a three-week Israeli blitz and invasion over the New Year of 2008-09, killed 1,400 Palestinians, mostly civilians. Thirteen Israelis died in the conflict.

Red Bull?s Mark Webber escaped a grid penalty for ignoring a weight check requested by the FIA during the qualifying ahead of the United States Grand Prix.

It was being anticipated that Webber will be facing a punishment by the stewards for his ignorance but they let him off with a warning and the driver will retain his third slot on the grid for the race.

?I'm pretty happy with qualifying actually,? Webber said. ?It's a very tricky venue in terms of tyres, circuit conditions and all those type of things together so it's easy to be out of the window here and not be super competitive if you don't get everything together. So I was pretty happy with the last part of Q3; we had to manage a little problem in the car which in the end I don't think would have cost us a position because the guys obviously were pretty quick and both did very strong lap times.?

A statement given by the stewards said that the Red Bull driver failed to fulfil the FIA request and did not bring his car to garage for the weight check at the end of the first round of qualifying.

However, the team realised their mistake soon after and the car was brought in. Their immediate action saved them from the penalty.

Webber stated that he was extremely satisfied with his position on the grid and that it was a very good place to start the race. He added that their main focus for the race in Austin was to secure the constructors? championship for the team. It will be a brilliant achievement for their base back in Milton Keyes and their engine providers Renault.

Webber?s teammate, Sebastian Vettel, who is leading the drivers? championship against Ferrari?s Fernando Alonso, was also of similar opinion over the constructors? title. He has stated that they are more focused on scoring points for Red Bull than worrying over Alonso?s eighth position on the grid. The team is currently leading the constructors? grid with 422 points while Vettel will be starting the race from pole, already ten points ahead of his rival.

Has any else tried the new Facebook Social Jobs App? For an app that took 1 year of development and partnerships, I've had nothing but bad results thus far.?

Unless I am not seeing it I cannot search a specific job title, there are no filters (meaningful) to sort the results etc. After the Apple debacle I never thought Facebook would launch something so half ass. I am curious as to how the partners listed on the page feel about that.?

The bigger questions is that the partners listed on the page are in this business. How could they let something like this pass the sniff test?

This is a basic as it gets. There is no room for fail in the Job Board business. It's been around way to long to screw it up.

business seminar.jpgMany of us in the so-called 'business world' have had the opportunity to attend a tradeshow or convention. Does it get much better than seeing another part of the country or world as part of your business travel? At the same time, you have the opportunity to expand your knowledge through seminars and break-out sessions. In my many years of experience, I've learned a few things about traveling for conventions.

Here are some Do's and Don'ts:

DO

Prepare - Learn about the convention prior to your trip. Know the name of the convention; where it is being held (hotel? Convention center?); what are the main topics being presented; who are the main sponsors? This is all information you'll need - whether for a taxi driver or if your boss asks.

Stay close to the convention - Whether you make your own travel arrangements or somebody books them for you, make sure you don't have to travel half-an hour each way just to get there. It increases your travel expenses and limits your ability to network with other attendees. (In fact, Best Western has many convenient locations in most metropolitan areas to keep you close to most conventions!)

Take advantage everything offered - Attend the breakout sessions; go to the 'networking mixers'; take notes; pass out your business cards; meet people. These are usually great opportunities to meet colleagues in the industry as well as potential clients.

Maintain Professionalism - While it is a more relaxed environment, don't forget to keep yourself looking professional. You probably won't be required to wear your standard business attire, but make sure you don't look disheveled. Get enough sleep and iron your clothes if you have to. Remember that you will likely be making first impressions to people that matter and you don't want to waste that opportunity by wearing flip-flops.

DON'T

Go Crazy with a Company Credit Card - Most people will either have a company credit card or will get a 'per-diem' to pay for meals and other expenses. But don't expect that your company will pay for your lobster and $500.00 bottle of wine. Stay within the budget or you may have to pay for your expenses yourself.

Be 'That Guy/Girl' - You're out of town and having fun. Which is great! But don't be the one that everybody else at the convention talks about...or worse, that your co-workers or clients will tell stories about when you get back to the office. Don't party all night and show up for the next day's seminars wearing yesterday's clothes. Networking with others is highly encouraged - swinging from the hotel chandeliers is not.

Forget That You're Still 'On-the-Clock' - Remember that, as long as the company is paying for it, you're still working for them and still representing them. Whatever you do, or don't do, can come back to haunt you. Your company's rules are still in effect even though you may be 1,000 miles away. You don't want get called for disciplinary action just because you forgot who signed your paychecks.

Traveling for the company and attending conventions can be great. You can learn new things, meet new people, and have lots of fun. Just remember what you're there for and stay away from the chandeliers.

    Google targets Android fragmentation with updated terms for SDK

    IDG News Service - Google has expanded its legal agreement with developers working on Android applications to specifically prohibit them from taking any action that could lead to a fragmentation of the operating system.

    The prohibition was added to the terms and conditions for Google's Android SDK (software development kit), which developers must accept before using the software to build Android apps.

    The previous version of the terms of service, published in April 2009, didn't address the issue, but the new terms published on Tuesday include this new paragraph:

    "You agree that you will not take any actions that may cause or result in the fragmentation of Android, including but not limited to distributing, participating in the creation of, or promoting in any way a software development kit derived from the SDK."

    Google did not respond to several requests for comment.

    The issue of Android fragmentation has been gaining increased attention, but it's happened largely as a result of actions taken by Google and Android handset makers, not developers. It's a problem because it means that Android applications may not run properly across all Android devices.

    "It continues to be a problem, both on smartphones and tablets," said Avi Greengart, research director at Consumer Devices. "Google has talked about multiple initiatives for dealing with it, but none of them have successfully addressed it."

    He cited as an example this week's launch of Android version 4.2, also known as Jelly Bean. Despite a high-profile launch on several new Google-branded devices, handsets and tablets from competitors are still without the new operating system.

    "HTC is rolling out the Droid DNA, which has an extraordinary specification list, but they can't claim they have the latest and greatest operating system," Greengart said.

    "[Google] perpetually puts Android licensees behind the curve," he said. "The software features that Google puts into the latest versions of its OS are often not available for consumers or for developers to exploit."

    That's a big contrast to Apple, which rolls out updates to phones at the same time and often continues to provide support and new features for at least a year after the phone has been bought.
